    Hi All,

    My Financee has a CCJ registered against her, taken out in Nov 2008 for a car, now the car loan was in her name yet the car actually belongs to her ex, he drives it and doesn't pay a penny towards it, she has never actually owned the car.

    As she works in the banking sector she cannot change jobs as the CCJ flags up and her applications are thrown out, is there anyway to transfer the CCJ over to him or sort it out in any other way?

    What sort of finance was this. Was it a cash loan which was used to purchase the car, or was it a HP or conditional loan.

    If it was the later the car still belongs to your friend.

        Hi

        On a HP agreement the car belongs to the company until the last payment is made when title passes to the purchaser.

        Generally, when an agreement is defaulted the car is re-possessed, the car is then sold and the proceeds is knocked off the balance owed.

        I would need to know more detail, but there is a possibility , that if the value of the car was not used to offset the amount claimed you may have grounds to set it aside.
