do you have to be on the electorol roll

i pay my council tax and i feel no reason for my details to be on the electorol roll. i realise its a criminal offence not being on the register but to my knowledge the last person to be prosecuted was in victorian times. the maximum fine now for not being on the register if they ever decided to enforce it would be £1000.00

i value my privacy, i do not do credit, i pay my taxes, contribute to society and obey the law

I believe there is an edited version you can ask to go on which is not available to all and sundry. Your local Electoral Registration Office should be able to give you details of this. I'm on the edited version.

one example with me is a dca trying to collect a statute barred debt from 1998 that goes through the dca runaround.

the electorol roll still gets given to the cra with your details on. that inturn allows a dca access and register to search as an outstanding debt for example, or address search which end up recorded on your credit file.

that inturn takes 8 weeks of going through a dca complaints proceedure to get the entry removed, then the cra only update once a month so technically a negative entry can be on your credit file for a period of three months before it is removed

Update on electoral register - The edited version is the one all and sundry can buy - my local council confirmed - so correction there. The general register can only be used for certain purposes, mainly to prevent fraud, and using it for any other purpose is an offence at law. In my considered judgement, unless a CRA has a legitimate reason - the onus of which lies on them - for searching the general electoral register, their use of the general electoral register may be unlawful. As for DCAs using it, yes, they can purchase the edited version and use it as they see fit, but if you have indicated on the electoral registration form your local authority sends to you that you do not want your details on the edited version, it makes it more difficult for DCAs to access that information.

The more people who ask for their details to be placed on the general register, the more difficult life will be made for DCAs and CRAs.

Having major problems with Council Tax at the moment, and we're not sure if we can do anything regarding the Council as we believe it is their cock up that has put us in the position of having the baliffs knocking. In my Partner started claiming HB & CT benefit in October 2011 - I moved out as it made it easier to claim and went to stay with friends so he was claiming single person occupancy, fast forward to June 2012 and my Partner returns to employment, informs the council that I have moved back in and single occupancy will no longer apply, they send out a revised bill but still with single occupancy, he contacts them and asks for another revised bill this time without the single occupancy - this never materialises, and lo and behold Chandlers are knocking on the door. I was on the electoral role from when I first moved in with him, but when I moved out, we asked that I be removed (didn't want DWP thinking I was still there). We had the ER people at the door a few nights ago asking for our completed ER form as we had not returned it, and they confirmed I am showing as living there, we had never asked them to reinstate me so unless the Council had put me back on when my Partner rang to change from the single occupancy ..... I'm thinking that if the Council added me to the ER, then surely they knew I was back living with my Partner so no excuse for sending out incorrect bill, which in turn wouldn't have meant us having to ask for a revised bill leading to the account being passed to the <koffspit> baliffs - any recourse here or am I clutching at straws - are Council Tax and Electoral Roll linked in any way? The LO will be paid in full on Monday, with only one fee of £24 for initial letter.

Also ... when my Partner originally informed them I had moved back in he set up a direct debit for the 1st payment to come out of the account on 1st August which they didn't collect, we assumed that this was because we had informed them that actually we should be paying more. We had a letter informing us that they were applying for the LO in September when technically we only had only missed 2 payments - 1st Aug & 1st Sept, is there a set amount of payments you have to have missed before they can apply for an LO as our payments were only technically 6 weeks overdue (1st Aug - 14th Sept when the letter stating they were applying for LO was recieved) ... still never received a revised bill with the single occupancy deduction removed.
