    Some of you may remember my case with the CSkills which was struck out in december of last year.

    I want to bring the case to the high court but under different particulars of claim.

    I read somewhere that a 6 month time limit exist on race discrimination cases in court.
    If this is true can I take my case straight to the EHRC and if so what forms do I have to fill in etc etc.

    Are there EHR courts (actual buildings) here in England?

      I would also like to use breach of contract legislation in case the race relation aspect of the claim is thrown out. I also don't want to use trading standard regulations but actual governmental legislation which would be harder for a judge to dismiss. Is there any reputable pay site where I can view past high court rulings?

      Here is how I want to argue my case.

      I paid for a Slinger\Signaller course july 2010. Before I could go on this course I had to pass Construction Skills health and safety test. Then I had to pass a theory test for the course and then a practical test. I was failed for the practical test. If I had passed I would've been given a red card. With this red card I could apply for work. While doing my job (slinger\signaller) I would have to do 100 hours. This would have to be verified by the site foreman or whoever was authorised to sign I had completed those hours. Once I have those hours and the signatures, I would then have to pass a practical NVQ test. I would then be given a blue "COMPETENCY" card.

      You can't do the NVQ without CPCS red card.

      My argument is this: Construction Skills failed me for a course that would only allow me to train to be competent. The second point is that they said I was unsafe and this was the reason I failed (pure BS), but how can that be when I had to pass their own health and safety test before attending the course?

      What legislation would cover my argument. I thought about using unfair contract terms act 1977 and questioning the reasonablity of the contract but this leaves alot of scope for a Judge to interpret the reasonableness of the contract. Is there any other legislation which isn't so open to interpretation?

        Yesterday i learned the defendant has asked for my claim to be struck out. i also learnt you can't be failed for an nvq. I have to wait another week til the court send me a letter confirming the reasons why.
