  • Claim struck out and costs

    I was the claimant in my claim and incurred costs. I have another thread about an incompetent judge, but this time I had a very reasonable judge who was very even handed. The defendant's solicitor asked for £13,500 but was given £5000.

    Can I pay this sum in installments as I don't have the money to pay the whole lot off in a lump sum?

    A word of warning for anyone trying to take an education authority to court. don't!

    Put your claim in with the Employment Tribunal within 3 months of the events you're claiming. Also don't use OFT regulations as they're criminally actionable (unless your injuried).

    Strangely I've spent a very large proportion of today talking to someone who wanted to do just that - take their local LEA to court.

    I cautioned against in her case, as you have above.

    In the past I have helped win cases against LEA's though, but you need to be extremely sure of your ground. A huge amount depends in what role you are taking them to court, parent, governor, employee, teacher, Headteacher etc....

    The differing level of support available to the groups who could potentially take an LEA to court are massive.
