I have received a copy of the decision from the Upper Tribunal today.
Decision: The application for judicial review is upheld. I make a quashing order setting aside the decision of the First-tier Tribunal sitting at xxxxxxxxx on xx xxxxx xxxx under reference xxxxxxxxxxx. I remit the appeal to the First-tier Tribunal ( Social Entitlement Chamber: Criminal Injuries ) for a full rehearing in accordance with this decision before a differently constituted tribunal. Any necessary further directions may be given by an authorised judge of the First-tier Tribunal.
Does the above basically say the decision from the appeal I had has been quashed and a new appeal hearing has been ordered with a different panel?
Anyone with any experience of the CICA comment on if they will appeal this decision and if so will they base the decision on costs?
There are a number of reasons for the decision which have been included and I will spend some time later trying to absorb them.
