  • battle with planning office

Hi, I have a friend who, recently built a new garden centre, and after a burglary, got a person to move onto site, as night security, and being out in the sticks moved a static home onto the site.
The garden centre does not yet have 3 phase electicity, and the hired generator is switched off when the centre closes at 5.30pm, then on at 9.00am the next day.
The static home was reported to the local authority, who visited the site, since then they have issued a letter with 28 days notice to remove the static home, as they interpret the planning laws, as temp building etc, can only be given temp permission at the construction stage.
The Owner of the garden centre is concerned, as at anyone time he has £150,000 worth of stock sitting there, he has a security system installed, but has been advised by the company that installed it, not to use it with the generator, as turning it off every night would damage the system.
Does anyone have any stategies, suggestions, or know how, of how to get temp planning for the static home, with the guard living on site, until 3 phase electric can be installed?
P.s an application for 3 phase electric has been subjected, and the garden centre owner has been advised, it could take up to 6 months for instalation due to the rural location.
    any help would be appreciated.

Swap it for a caravan Near where i grew up, there was a large stables about 3 miles outside of the village. They did have electricity there though, but they kept having horses stolen, even with the alarm system (police were like 15 miles away at least).

They got two caravans in and get security to 'live' in them. They were on wheels and were occasionally moved around. Not sure if this would negate the rules, but they certainly got away with it.

A caravan would be an issue with planning as well as the land is not for residential use (if the security guy is living there) think you can get away with around a month a year residential on business use land. However, the static building would also need temp permission as an ancillary building for the business use of the land (for overnight security), so whether caravan or static, if someone is living in, or staying overnight to guard the premises, planning would be needed.

(only my thoughts though you really should get your friend to speak to planning)

Actually, would the electric still being installed class as under construction still, I'd guess not with the generator, but worth a look in to maybe.

lol getting away with it and conforming with planning regs are different things Assume the guard can't stay within the actual garden centre?

Cheers chaps, he has written to the council enforcement, asking for an exstention to the 28 days whilst a retrospective planning application is submitted.
