Local Government (Discretionary Payments) regs 1996

The Local Government (Discretionary Payments) Regulations 1996 have since had amendments made. I'm claiming from 2002. Will I come under the current amended legislation or that which was in place at the time? And are public services under an obligation to have a written policy in place to comply with said regulation? (My ex-employer doesn't.)
