  • Audio recordings in own home

Hi all, I'm in dispute with a rogue builder who I've made a complaint against. The builder has stated that they have made audio recordings of our conversations in my own property. I was not aware of this and did not consent to it.

Can anyone please advise if this is legal? Thank you.

If you’re not working on behalf of an organisation and making recordings for personal use the answer is yes:

if you’re in England or Wales you are permitted to record someone without their knowledge or consent so long as you’re doing it for personal reasons and not acting on behalf of an organisation.

I suggest you read the Regulations of Investigatory Powers Act 2000 (RIPA)

Just to add to this for clarification(?), I believe you can only record conversations that you are present for or you are taking part in (eg telephone). So you can't "bug" a room, or record a conversation where you are not present and to which you are not a party.

I am unsure if you are saying your house was "bugged" but go to this website admit will explain everything. Then you can come back here for help in what to do next.
