So as you all know the ongoing saga, I've been involved with solicitors for 3 years because my brother refused me payments from a Discretionary Trust for 3 years.
He was telling me and my father that "I want that trust for my grandchildren",.
My late mother also stupidly put in her will that if anything happend to me my brother would get my share, how idiotic can you get as that gave him another incentive to refuse me money.
My late mother stupidly used her Financial Advisor to draft the will, I believe this should have been deemed invalid on the grounds of influence as all of her assetts lied with his private firm.
So, after 3 years I went and got legal advice on a no win no fee basis.
My legal fees now stand at just over £37K.
I have warned the Financial Advisor that I can have statements made against my brother for repeated refusal of any money from the Trust.
If my brother refuses to allow the Trust to pay for my legal fees due to the fact I can prove he repeatedly refused me money, where do I go from here?
would I be able to chase him personally for my legal fees through a claims court?
