  • AWOL neighbour causing property damage

    Hi everyone.

    My neighbour has moved out of his property and is failing to maintain it. This has been ongoing since last year.

    Basically, my front walls in my lounge were getting wet last winter and I thought it may be that my gutters needed cleaning (even though I do have them cleaned regularly). I had a company out to clear my gutters, however, they stated that my gutters were not particularly needing attention but my neighbour's guttering was actually fitted incorrectly.

    We live in terraced houses and my neighbour has completed certain works himself (badly!) but our shared downpipe is on his property and the gutter man said that his gutter is sloped upwards in the middle which was affecting the escape of water from our guttering.

    I have sent my neighbour letters regarding this, (I am unaware of his girlfriend's address - so one recorded to his business registered address, which has been signed for - and one to next door but not recorded as nobody lives there) however, he has failed to fix this problem or respond.

    A few weeks ago I had a roofer out regarding another job on the back of my property. Whilst he was here he looked at my guttering (both front and back) cleaned my back guttering, however, stated that my front guttering was relatively clear, however, my neighbour's guttering was totally blocked and also confirmed that it was sloping slightly upwards in the middle.

    This is affecting my property and has ruined all my interior paintwork and is causing damp in my lounge. When it rains heavily the water in the guttering cannot escape, additionally, due to the substandard workmanship on the joint of the differing size of guttering between our properties (completed by my neighbour) this rainwater is cascading down the front of my property.

    Can anyone advise what further action I can take please?

    Is the neighbour's house empty, or is it let to tenants? Without whose leave is the owner absent?

    I am thinking that one option may be for you to get those gutters cleared and to pay for a new and functioning joint. This preventive/remedial work may be cheaper than the cost of continuing work on your property.

        Thanks for your reply Atticus. The neighbour has moved in with his new girlfriend so the house is empty. I do not have a forwarding address to further communicate with him.

Each couple of terraced houses share yards, gutters etc on the back too, however, as he is the end property then we just share a down pipe on the front.
