    Hi,

    I am aware that countering a settlement offer usually voids the offer made.

    Are there any examples/case law or precedents I can show in the case of an offer countered, but then a few days later accepted?

    Specifically offer was made to me, I queried why it appeared to be in settlement of many other issues and not just the one being litigated? I told the offering party that settlement of all claims would be a much higher total.

    This was then clarified as not being the case. I was never told the offer was now void, and accepted it on this basis, within the timeframe allowed for acceptance.

    So hoping for some existing precedents or court cases that I can present at a hearing.

    As a matter of contract law, making a counter-offer amounts to a rejection of the initial offer. That initial offer is no longer available, unless put back on the table by the party who made it.

    There is no legal precedent that will help you.

    Different rules apply to offers made under Part 36 of the Civil Procedure Rules (Part 36 Offers).
