I am aware that countering a settlement offer usually voids the offer made.
Are there any examples/case law or precedents I can show in the case of an offer countered, but then a few days later accepted?
Specifically offer was made to me, I queried why it appeared to be in settlement of many other issues and not just the one being litigated? I told the offering party that settlement of all claims would be a much higher total.
This was then clarified as not being the case. I was never told the offer was now void, and accepted it on this basis, within the timeframe allowed for acceptance.
So hoping for some existing precedents or court cases that I can present at a hearing.
