  • Garage door sticking out from property...car collides.

Up and over garage door ....is raised up but its of the very old style where it sticks out into the back lane [ie into the public road] by about 60cm...

Only profile visible is circa 4cm 'strip' [side profile]...at circa head height.

Who is at fault if a van hits the door...homeowner or driver??

Note this was a 'near miss' not an actual crash...so nothing too much at stake!!

On this information, the property owner should be concerned about liability.

It would be a good idea to take a photo from the side when the garage door is open. It could prove useful if there is an accident in the future involving the door

It would be an even better idea to replace the door with one that does not create a potential hazard to road users as it projects into the road!
