  • Misconduct in a public office

Who do I need to contact to investigate misconduct in a public office?

I have evidence (FOIs and internal documents) to support my claims.

The issues in the documents were known to senior managers, the H&S department, Trades Unions, HR and the constituency MP.

Misconduct in Public Office is a common law criminal offence so you need to report it to the police. They can investigate it and refer it to the Crown Prosecution Service for prosecution in court. I am assuming this is in England.

Would I need a solicitor? What role role the police pla e.g
investigate or simply pass info toI CPS

Some of the documents are not public documents, what risks do I face by providing these to police?

You aren't telling us what this is about so it's difficult to answer. Most crimes are investigated by the police, that's what the CID do all day. If they think there is sufficient evidence they will pass to the CPS and it's CPS who decide whether to prosecute. In principle you no more need a solicitor to report Misconduct in Public Office to the police than you do to report that you've been burgled, but you might find in practice the police are more willing to devote resources to it if the report comes via a solicitor.

A solicitor would be best placed to answer your questions about documents when they have seen them.
