  • What is classed under Schmidt case law acceptable for Trust Accounts

    I received a copy of a letter from the Trustees Solicitor.

    They are refusing to supply copies of bank statements for a form of Trust Accounting.

    They have refused to answer over the fact that Land Registry records showed that my brother paid £306,250 for my late brother property, yet failed to pay this full amount into the Trust, they claim no financial loss to the Trust.

    Refused to answer over that the brother gave a sellable assett to a non beneficiary of the estate ie my late mother' car.

    Refusing to pay for my current legal fees, they claim I have no right to any money as its a discretionary fund, yet the will makes it clear I am entitled to payments from the income and capital.

    Complete denial about being refused money for 3 years on the grounds I have the mortgage paid, my argument here is that if I had my monies in the normal way the mortgage would have been the first thing that would have got paid, plus the brother was making comments to family members he wanted the rest of the money for his grandchildren.

    Any advice please, is bank statements a form of Trust Accounting, so that it can be made certain the brother hasn't been embezzling the fund which is why he is refusing for the bank statements?

    You have had advice from solicitors and Counsel. They are specialists. They have had the advantage of detailed instructions from you and sight of all documents. They are not random anonymous people on the internet responding to a few short paragraphs.
