I have a little knowledge about contract law but nothing about defamation law. If a claimant sues under contract law then damages are limited to what the claimant can demonstrate as their actual loss due to breach. However how does this apply in defamation ?
For example a claimant can sue for defamation as is often the case where celebrities sue a newspaper for alleged reputational damage but it would be impossible to quantify in monetary terms any loss. So if a defendant is found guilty does the court apply a value more as a penalty rather than reimbursement for an actual loss ?
