  • HM Courts and Tribunals Data Breach

    Hi All,

This is a relating to my brothers council issued PCN.
He received a PCN, challenged it but never received a reply, then it went to a charge certificate and then he was waiting for the court claim to come through so he can set aside the fines and bring it back to the original fine amount.

HM Courts and Tribunals did acknowledge 'something' was sent to the them but 'apparently' we filled in the wrong form. Basically, HM Courts and Tribunals sent us back an incomplete application relating to a completely different individual - so my brother received back the other person's original app form, along with their address and everything. This is a major breach of data by a government body.

Was recourse does he have in this regard? What would you suggest he does?

Sorry if this is in the wrong area but thought I'd post a thread here as a starting point.

    Thanks in advance.

The other person whose personal data has been wrongly disclosed should complain to the ICO.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
