  • Solicitor issue

    Hi there

    I have been trying to find out if our solicitor let me down or if it was my own stupid fault for not engaging my brain
    As I haven't found a clear answer online I have found myself here.

    Basically I was a witness in court 2 days ago.
    It was an appeal hearing .
    One of the reasons the original case failed was due to no documentation from my gp detailing my mental health condition which plays a part in the case.
    For this appeal I gave 2 very detailed letters but they were dated 2017 and 2018. The judge took these into account but asked why haven't you provided a recent dr letter.
    So to be honest it didn't cross my mind to get a recent letter.

    My question is should my solicitor have pointed this out to me and told me to get a recent letter as it would be a very important part of the appeal?

    Basically was it the solicitors job to go through all paperwork and point out what a stupid person I was for not getting a recent Dr letter.
    Or is it my own fault and not a case of the solicitor not doing his job.
    I know I sound like a complete idiot and I obviously am but a stupid mistake seems likely to result in a fail case.

    This might be your lawyers' responsibility (but it might not).

    Do you have the full reasoned judgements of the original decision and the appeal. Careful consideration needs to be givento the judges' reasons for their rulings, and whether current medical evidence would have helped you.

      unfortunately I have been informed today that the case has been refused. The case was a pilot for fast track conclusion

        Having read the judges reasoning it seems clear to me that it was a large part due to lack of proper instruction from the solicitor and we were not prepared for the judge finding holes in the statements with confusion to dates etc
        I can explain the case in more detail if you or others can advise if we have a case for the law ombudsman to look into
        The case is a matter of immigration

          Assuming you are the same user "Guest" who has the other similar thread currently open, you need to keep to one thread otherwise there is a liklihood that posters end up at cross-purposes.

          [Edit: Ah. I see you actually have two other threads and you have already been advised to put everything into one thread. It gets very confusing when people ask a slightly different question multiple times]
