  • Trustees refusing me money for a new car, but am registered disabled

    I have been refused money for a new car, even though I benefit from a family discretionary trust.

    I am entitled to both the income and the capital.

    My brother has refused me money for a new car on the grounds I don't drive.

    I was born with disabilities due to have a hole in the heart, and this year I found out I have a rare genetic disorder called DiGeorge Syndrome, which the the root cause of my ailments.

    I am registered disabled.

    Can I argue under either the Equality Act or Disability Act that refusing me a new car prevents me from obtaining access to transport, and I need reliable transport to take me to appointmts, and stuff.

    What section under these Acts can I use?

    Is there anyway without going through the Courts, I can get my brothger removed as Trustee as this is blatant discrimination in my eyes of refusing me access to transport?

        I haven't seen the terms of the FDT, so cannot say.

        Not without going through the courts, or persuading him short of.
