  • Airline baggage loss claim

    Hi

My bag has been delayed for almost 2 weeks now, and the 21 day deadline (this is from the Montreal Convention) for assuming it's been lost is approaching.

Assuming the bag does not get returned, and that I submit a claim after 21 days, I have two questions.

What happens if I receive a payout on the lost bag and the bag eventually turns up?

Also, what happens if the bag turns up after I've submitted the claim, but before the claim has been paid? I assume I just stop the claim? I'm interested in this one as the insurance coverage is new for old.

    Many thanks

    Abo

Who would you be claiming against - the airline or your insurer?

Insurance companies usually have terms covering what should be done if your property is found after they settle your claim.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

Unfortunately, I encountered a similar situation, but my luggage was returned before the deadline.

I would claim against my insurance company. I'll see if I can find what they say about this situation.

        Thanks
