  • Assaulted by neighbour, advise on all criminal laws. Disappoint by Police.

    Hello everyone.

My questions here really relate to issue with the Police force cherry picking jobs.

I had an event where by my neighbour though that they had the right to elevate themselves over a 6ft fence to project a pressurised lance of water in the form of a jet directly at certain parts of my garden and directed water into my face and electronic property i.e phone. She also swore at me during this time, in addition she got her relation involved as they where clearly communicated by name in the audio of the video. Which means joint enterprise.

Police failed to attend a 999 call and a follow up welfare call. Finally when they did come to collect the evidence that I had taken at the time. They did not even take a statement.

I was advised that it would be dealt with in house, and that it would not get past the Police desk sergeant, however I clearly stated that there is indeed case law to a similar act, see below.

    https://www.dailymail.co.uk/news/art...s-assault.html

It appears that though mine was a little more serious as the pressurized jet was used to enhance the action used. This was used as a form of weapon directly at me. May I point out there was no engagement prior to this throughout the whole day.

If you can’t have faith in the Police force to do and act as they should in accordance to the law then, something is very wrong indeed. I was given the clear indication that this matter was not going to be put to the courts even though another one in the press has. I did not think the law was any different in that county from mine in the UK.

This left me a little concerned after how does one claim for damages to phone other than small claims court.

How many breaches of law has occurred in this instance, please let me know.
    For Mental, Physical and Property.

    Thank you in advance.

When resources are stretched, priorities have to be set.

      It sounds awful.
Unfortunately a contrary decision taken elsewhere is not a precedent which the police have any obligation to follow They exercise their own discretion. I doubt this just came out of the blue, there is a bigger story.
The first thing you should do is to keep a proper record of whatever happened. Write every detail down while it remains fresh in memory, and keep that up to date.
Second, never do anything to get your own back. That is the surest and simplest way of persuading the police to say 'A plague on both your houses'.
It may look impossible now but look for opportunities to take the heat out of the situation with the neighbour. That is the only genuine answer to your problem. Anything else - including police action - will only make things worse.
Look out for the Protection from Harassment Act.
