  • Amazon at it again, this time is SERIOUS PROPERTY DAMAGE.

    hi all.

    I'll be brief to start with and see how this one rolls out.

    Basically, had a delivery 2 weeks ago from amazon, (self employed own van driver).
    And by the time I've got to our gates he's spun a 3 point turn in our drive and TOTALLY screwed up our beautiful grass verges.
    It's a 150 yard long gravel drive with lovely kept grass verges each side with very big and clear "no turning" signs all along it. He's done a lot of damage.
    I do mean DEEP rutts, mud, wheelspins etc. Looks diabolical.
    I couldn't get up fast enough to catch him as I'm off work with back issues.

    Now, after several rounds of email tennis I got a call from the subcontractors whom employ the driver. He of course denies it. I tried to explain to her that this isn't a town verg by a block of flats, it's a well kept private country house of which our grounds are kept immaculate. (photos were supplied). Her reply astonished me with the reply of "well we can't pay everyone compensation that ring up over damage as we would go bust".
    I just said well so you're saying it happens all the time then for you to say that to me?

    I did try then to point out that I was not after lots of money, just a few hundred pounds to get the eyesore rectified and that I would wish this not to escalate any further as at the end of the day it could cost their company a lot more. And also pointed out that our house cleaner witnessed the whole incident from one of our top windows. This made no difference whatsoever.
    The person on the phone (transport manager apparently) would Not give me her email, all I have is her mobile number. And the main couriers email whom employed them.

    I really can't let it go this time as he's really done damage.

    Any pointers of who and what to write to them will be very welcome.

    Write a Formal Letter of Complaint, mark it as such. Explain whats happened (with pictures, if you have before pictures that would help), why it's their responsibility (they hired the courier firm) and what you want them to do (reasonable compensation).

        I would also complain to Amazon
        They arrange the couriers, who are acting as agents for amazon

          Thank you for forwarding my details to the subcontractors. Unfortunately they were less than helpful.
          And also rather unfortunately for them, the driver has denied all knowledge of doing said damage.
          I have seeked and obtained preliminary legal advice on this matter and I legally can and will give you some outline information as so far.

          I tried to explain to the person on the phone that not only was this damage viewed and seen quite clearly taking place by an independent witness, I have also taken further evidence such as veichle tyre tread casts (which will be traced and matched to the commercial vehicle) (at an additional cost) along with other items which will of course prove beyond ANY reasonable doubt that this "was" actually occasioned by the driver at the time.

          Yourselves as the employer of the contractor are wholly and legally responsible. (this is in regards to health and safety issues, risk assessment and most importantly a satisfactory level of comprehensive insurance as regards to property damage ect).

          At this time I am not regarding this as criminal damage and just "bad, careless driving".

          I am seeking property damage compensation for the nominal amount of seven hundred pounds (£700).

          I have tried very persistently to have this matter resolved swiftly before it is taken to a more serious level of litigation which will of course involve much more costs to both parties.
          I will remind you that as the evidence is somewhat overwhelming and should this case escalate to a small claims court I am confident it will be ruled in the plaintiffs favour and therefore cost your company considerably more to pay both sides legal fees plus any additional fees/increased compensation etc.

          I will conclude by saying once again, I have been more than reasonable with both the very small amount I am seeking and also the fact that I am inviting you to resolve this whole incident in a speedy manner before costs escalate.

              I know right.
              I've just had it estimated by our grounds keeper and his son and they reckon about 1500 pounds worth of damage.

              So they're getting off lightly really.

              Well I've sent it now, so any more heel dragging I'll just get my solicitor onto it.
              I'm sick of them being so careless to other peoples property.

              I'll try that letter then just leave it to the pros.

                But this would be small claims track where you can't claim for legal costs.
