  • Landlord Fly-Tipped in Garden

    Good afternoon,

    Looking for some advice as the police are now involved.

    My sister came home from work last week to find contents from her neighbours house in her garden. When checking her ring camera, it was dumped by the landlord of the neighbour after they had evicted their tenant.

    She contacted the Landlord on facebook and asked them to remove the rubbish into the garden of their own property but they became abusive and told her to get rid of the rubbish. She replied and said that wouldnt happen and gave them a few days to remove the rubbish or it would be placed in their garden. She was met with threats of getting us charged with quote ' Malicious damage / criminal damage and fly tipping'

    I called the police for advice and they stated that it would be reasonable for me to do this so thats what happened.

    We took lots of pictures and a video of us placing the rubbish back where it came from.

    Now my sister has said that the police were at her house today to speak about the issue. (She wasnt at home and it was caught on the door camera)

    Any advice on how to deal with the police?

    Show them the original footage of the LL putting it over the fence and state that it was merely being returned to its rightful owner.

      You could also lodge a complaint with the council, it's 'outrageous behavior'.

        Whilst understanding Kawasaki's reaction and returning the "goods" the law has been broken twice.
        First time by the neighbour throwing rubbish over fence, the second time by Kawasaki returning it.

        If rubbish is fly tipped on your property it becomes your responsibility to dispose of it correctly, if necessary by employing a registered carrier. To do otherwise is a criminal offence.
        Having disposed of it correctly you then seek reimbursement of your costs from the fly tipper.

        Will be interesting to see if the police take a more pragmatic view (which is more than likely under the circumstances)

          I would argue that the items were merely returned to their rightful owner. I expect the Police will have better things to do.
