Im new here so hopefully some of you could offer some great advice.
There is a long outstanding debt for tax credits going back to 2007 where HMRC are saying I have been overpaid by c. £3500 (half of a c. £7k debt split with my ex Mrs). I am certain this was due to either an error in the way I completed the form or HMRC have had an issue when loading the data into their system. Briefly, when the form was completed, I indicated I earned, say, £45,000 and the calculation was based on exactly double that. As far as I remember, I never received a satisfactory explanation or evidence from HMRC to confirm this. At that point I got divorced, moved house a few times, and I would periodically - once every 2 years perhaps - receive a 'reminder' letter to say it hadn't been paid which I have kept safely but as there was no 'demand' for it, it has sat there dormant.
Recently, I understand that DWP have now taken over the debts and are chasing me for it. I received one letter recently followed by a DEA a couple of weeks later. So now it's starting to get serious and I need some expert advice!
So firstly, I do not believe the debt is valid and I don't beleive I have had any suitable response from the HMRC to explain this. Is there any way to ask them for evidence 14 years later to back this up? Secondly, if we were 'playing HMRCs game' - I own a Limited Company (incidentally they have sent the letter to the wrong address too) so is there any way the Ltd Co can extend / refuse to sort this out whilst it is being queried? Is it correct that there is no statute of 6 years on tax credits? Anyone else been in a similar situation?
