  • Action against the police in magistrates court

    Hi all,

    I am interested in the process by which action can be taken against the police. I believe that the matter should be done via the magistrates court.

    Following an arrest the police retain items as part of their investigation. Typically they hold the items for as long as they want. Is anybody on this forum familiar with the process to start an action against the police that would end up with the magistrates court ordering them to return what they took?

    I am also keen to figure out the process for a wrongful arrest claim. Would this also ultimately be dealt with by a magistrates court?
