I'm making submissions to the public services ombudsman in Scotland regarding my mother who died saying that the council care partnership was negligent and in my submissions I tell of a phone call I had with someone at the care partnership. The complaints reviewer has decided not to take anything further giving reasons that there was no evidence. When I asked what would be classed as evidence he said that the reason that he couldn't take things further was because I had only supplied circumstantial evidence so he needs more etc.
so I can ask for a review by the actual ombudsman but they can only change the decision for specific reasons like errors of law , more evidence , demonstrating how they made the error and things like that.
I had the conversation on the telephone , I defiantly did but the partnership are denying this.
my question is , are my statements circumstantial evidence ? Ive read different things on the web I've read that verbal evidence is direct evidence even if not substantiated etc. If I can say to the obudsman that what I've said is the truth and it's not circumstantial evidence I can maybe get her to change the decision by reviewing it and any help on this definition of evidence would be appreciated.
