  • Vehicle Theft - Gated Car Park

    Afternoon all.

    I am posting in this section as my issue falls under a few categories.

    I live in an area with gated car parks that require a code to open. There are also pedestrian gates that also need a code. But these gates have not been working at the entrance to our car park in many months.

    Last Thursday my Motorcycle was stolen from the car park and set on fire in a local play area.

    My question is, Do I have a case to sue the property management company for not maintaining the gates? If they had been working the chances of the bike being stolen are very small as this would of made it harder to get the bike out.

    Surly the residents here have a reasonable exception that their vehicles are safe when in the car park?

    The landlord said they had reported the gates not working to the PMC and I had spoken to them my self about it after the theft (I did not inform them of the theft) and they tell me that a job was raised to get them repaired in August but no action had yet been taken.

    What are your thoughts on this issue?

    You could possibly make a claim for negligence against the freeholder/management company if the property had been advertised as "secure",
    but whether or not you would be successful is another matter.
    If your motorcycle is insured they might pay your excess, just to dispose of the matter.
