  • Privacy issues related to recorded phone call with someone now deceased

    Over a year ago I had a telephone call during which the person I was talking to made specific claims and allegations. Sadly this person has died. The contents of the call included several very specific claims and allegations which are of use to me now.
    Where do I stand with regard to using the recording of this call to support myself given I cannot get their consent to do so?
    I should point out that this person was aware that all telephone calls on my phone were recorded and the reasons as to why I did this.
    Could anybody else take any form of legal action against me for using these recordings?

    Recital 27 of the GDPR confirms that data relating to a deceased person is not subject to the GDPR although member states may introduct rules locally. I am not aware of anything in the Data Protection Act 2018 relating to obligations in the use of data belonging to a deceased person.
