    Is not asking the rape accuser to prove she was raped not asking her to prove a negative - that she didn't give consent?

    Like asking a theft accuser to prove they didn't lend their possession out.

    I guess the definition of rape plays a part. Could 'without consent' mean, by force or threat of physical force which would be asking to prove a positive.?

    Are these a hypothetical questions, or following an actual event?

    These situations have to be dealt with extreme sensitivity, and it would surprise me if a person alleging rape was asked outright to prove the attack.
    You are correct in referring to the definition of rape, although it would be better to refer to "the definitions of rape" as there are different types.
