  • Bar refused to call ambulance

    Hey guys, I hope this is in the correct section, but I'm sorry if it's not.

    My brother in law (35, Northern Ireland) was in a bar celebrating his friends baby shower this passed Sunday from 3-5pm. The baby shower was held in the activity room above the bar. My brother in law had a few beers but was by no means drunk. He said goodbye to everyone and went to leave at 5pm, when he slipped and fell down a flight of stairs. According to the staff who were working that day, he was lying on the ground screaming in pain and drifting in and out of consciousness. A few workers picked him up and set him on a seat, however when someone said, "ring an ambulance" they were told that the ambulance wouldn't come to the car so they refused to ring.

    Eventually he just passed out, and 2 patrons of the bar lifted him and carried him home. Luckily he only lives a couple hundred metres away. They left him unconscious in the driveway. One of his friends passed and seen him lying there so picked him up, carried him inside and set him on the bed.

    Fast forward to 9pm he wakes up needing to go to the bathroom. He tries to get out of bed and collapses on the ground screaming in pain. Then he notices noti his ankle is about 3 times bigger than usual and his foot is facing the wrong way. After calling for his mum and getting his dad to drive him to the hospital he finds out that not only does he have a broken ankle but his neck is also broke in 2 places and has had to be completely immobilised for his own safety.

    The doctors say that he is very lucky because the way his ankle was broken, it was cutting off circulation and if left any longer he could have lost his foot. Also because his neck was broken, the way the bar staff lifted him off the ground and put him in a chair, they could have caused paralysis, but they cannot determine if his injuries were worsened by moving him, or if he just got very lucky.

    He has been in hospital for 6 days now and is going in for his second operation to try and set his ankle.

    He is a self employed painter, and now is unable to work. His is hopefully entitled to ESA, but it will be a fraction of his usual wage. Also, we just found out that his previous employer wasn't paying his stamp, so that will affect his contribution based ESA claim.

    Is there any legal president that he could claim against the bar? Something like gross negligence or danger to life? Just to try and get him some funds to live until he can get back to work.

    From the details you give I see no hope of a successful claim by your brother in law

    You make no allegation that the stairs he slipped and fell down were in any way the reason for his fall.

    There is no legal duty on any person to call for emergency aid for another person

    As the doctors cannot determine if his injuries were worsened by moving him, he would not be successful bringing a case against any of those who "assisted" him.
    Besides which so many people moved him that even if his injuries had been impacted adversely, it would be nigh impossible to identify who exactly would have been responsible.
