I recently had some unfortunate issues with a solicitor. I raised a complaint and, according to the firm's own complaint policy, was entitled to escalate it. I explicitly asked for this to be done and it wasn't. In the circumstances, I have been denied due procedural process.
I complained to the SRA and they wouldn't lift a finger. Does the solicitor's actions not amount to professional misconduct? The SRA code states as follows:
“O(1.11) clients' complaints are dealt with promptly, fairly, openly and effectively;”
Also, the matters I complained about were connected, albeit casually, to the Equality Act 2010. Does section 27(2)(c) not apply? In other words, have I been victimised? If so, the SRA code states as follows:
“O(2.1) you do not discriminate unlawfully, or victimise or harass anyone, in the course of your professional dealings;”
