  • Travel company issue

    My daughter recently went on holiday with a supported holiday company unfortunately she had a bad accident that meant she was in hospital for 2 weeks until her insurance could fly her home , a person from the group stayed with her and now has sent an invoice for expenses which is fine but rather than have it submitted to the insurance company they have taken the cost from the money they have for future holidays my daughter had paid for !

    Can they do this ?
    do i have any recourse ?

    Will your insurance cover the costs? Do you have a contract with the holiday company?
    Sorry i'm just thinking out loud, it might be irrelevant, I am not employed in anyway in the legal profession, please ensure you research any advice I give before using it I have been known to be wrong on multiple occasions.

      Insurance are covering all the costs so far but the invoice I receive has things like £800 for phone calls with no evidence to support the cost

        Can you post up, or give a link, to the company T&Cs?
        Was the money already paid for future holidays paid as a deposit?
        If it was generally the company have no right to deduct from it to pay their invoices for other things

        Obviously the invoice needs to be itemised and the expenses justified
