Hi all!!

I am posting on behalf of my brother. His wife walked out on him and to cut a long story short, he and his wife own their home outright. My brother feels uncomfortable remaining there after the breakup and he wishes to realise his half of the asset. His estranged wife is less than keen on this idea and so he's asked her to raise the money to buy his share. In these hard times, she is unable to do this. My question is this, what are his rights now in terms of forcing the sale of the house so he can take his share and begin rebuilding a life??

Divorce her and I would think this issue should form part of the legal process of divorce.

If she can't afford to buy him out then he does have the right to force the sale of the marital home if the marrage is unretrevable

But I am not sure if there is a period of time he would have to wait (after they are officially split up) before he can do this

If he is not seeking a divorce yet, I would also advise him to get a legal seperation document drawn up by a solicitor to say who gets what and when, after everything is sold or seperated, if he has not already done this, that way he has everything is in black and white and she won't be able to fleece him

You will find that no court in the land will make her sell the property until all the children have turned 18, unless you can prove she is uncapable of looking after the children, and proof is paramount, been there seen it done it, and done it another 2 times with my brother (not me , kids and wife urrgghhh). I am not gay mind, can't take pain!!

I presue the reasson she is reluctant to sell is because of the poor state of the market at the moment, house prices are slowly rising, how about renting the property out untill the prices go up and splitting the proceeds, may give you enough for a rental on a flat, just a thought.

If the children have turned 18, and not in higher education, get a solicitor, and make her sell the property, it is your entitlement
