  • Refinement of existing Interlocator

    My wife eft when my son was very young (4months), I fought through the court and after 7 sessions I ended up with a decent interlocutor covering, weekend access, holidays, birthday and Christmas. It was concluded by the time he was 2 but he is now 7 and the contents are, in some cases dated and wherever there is a hint of "greyness" in the contents the access is abused. I'm keen to go back to court but the practise I used are charging a fortune for what I think should be a relatively simple process. I'm thinking of representing myself but lose my bottle everytime I think of starting. I'm seeking a few bits of simple advice initially:

    1 What age roughly are my sons views considered?
    2 Can I build a mobile phone into the new agreement for contact with him whilst ensuring it is not abused by his mother with calls to other people?
    3 Do you think the court will give a better outcome if I pay for a solicitor to represent me?

    Hello, sorry for the late reply and hopefully the advice is still useful to your case.

    To answer the first question, it depends on the child. After a CAFCASS report is ordered by a judge, the family court advisor will look and assess both the child’s age and their level understanding of the application before the court.

    As for the second question, there are no specific rules to limit you which cellphone to use to contact your child.

    For the third question, this solely depends on you. In my opinion, family law solicitors are experienced in dealing with such cases, and therefore may be able to provide further support to your case.
