Pregnant wife moved abroad.

Hi.

My wife is from an EU country. We got pregnant in March. She freaked out a month ago and went back to her place of birth.

I don't believe our child would have the best/safest upbringing there. She would also grow up speaking another language, therefore I wouldn't be able to communicate properly with her.

Our family home and all of the baby stuff is all ready for her. There is a large support network here.

What are my options for getting my child back to the UK?

Hi Pioneerpapa, very sorry to hear about your dilemma however all is not lost. I believe that she is still pregnant unless it was March 2017, which means he has had the baby. What I will say here is that it is so important to have your name registered on the child's birth certificate as this will give you parental responsibility. You will then be able to have equal say and making of decisions regarding the child's welfare. You will need to talk to her about this asap, if you have to travel to Europe to see her and talk about this, so be it. After the child's birth and your name is registered on the child's birth certificate, first you must be involved in the child's day to day upbringing and keep child maintenance going. This way you will be able to start proceedings under the Hague convention (legal aid may be available) if she refuses to return the child to the UK, say to spend summer holidays with you, see your parents, relatives, siblings etc. This is a complex area of law and would advice that you seek independent legal advise from your local lawyers.
