    Hi

    Can someone please advice.

    I have been trying to get ex-spouse to go mediation through solicitors and refused to negotiate with solicitors. They went ahead sent me a offer proposal, which is very insulting. The facts stated with the contribution on the offer later are inaccurate and the property value is inaccurate.

    I have previously told them that I will only discuss at mediation and will not discuss with her solicitors regarding finances. I have also given them timeframe which their client would have to attend to MIAM and I will be referring the matter to court after this date.

    After receiving their offer proposal:

    Would their be a problem if I ignored their offer letter that they just sent since I have been refusing to discuss with their solicitor and wait for the timeframe (she was given 3 weeks to attend MIAM), which I set for their mediation that I set to pass and go to court after?

    They said that if negotiation fails their client can go to mediation. However I do not even want to negotiate with their solicitor.

    This happened to me. My ex wouldn't go to mediation. Made a very insulting offer, wanted everything. Including my home to move his women in.

    Expected me to take it as I was effectively homeless and no job.

    I ended up at final hearing with solicitor fees about 25K. :tinysmile_cry_t: I did reasonably well at the final hearing so don't sell your self short.

    Divorce is painful and can be expensive. Would I do it again if I had to, to get what I felt I deserved. Absolutely,

    DO you have young children ? I didn't.

      The letter doesn't even have "Without prejudice" written on it and her lawyer appears to be a right nut. I am out of the jointly owned FMH and the locks are changed.

        I didn't go to to mediation and didn't reply to their offer.

        is there much assets in the relationship ? who is the bread winner ? Have you worked it all out ?

        I would definitely try and mediate if possible, particularly if not a lot of assets involved. Sometimes it's just not possible.

        No party should be changing locks on the property without providing a key unless they have good reason to change.

        I had the same problem and went to my home with a locksmith to show I could not be locked out of my home. Although I never lived there after the breakup. I had no choice. He moved his mistress in and manufactured a restraining order to stop me going the property. after I found his mistress there alone one day.

        The main thing is try and be amicable and mediate and move on with your life. It will work itself out.

          She earns a bit more than me. yes the house is the main asset where we are joint owners. I asked for the keys through the solicitors. I sent an email around to their solicitors saying that I will involve a locksmith and they are threatening me with an injuction if I did that.

          After you ignored their offer letter, how long did you wait before you took your ex to court?

          They have given me 14 days to reply to their letter. Their view is that if the negotiation fails then it can go to mediation. How do I emphasize that I will not negotiate in correspondense with her solicitors and I will go to mediation after they sent their offer letter?

          If I do end up in court is what do I tell the judge that they are not willing to go mediation unless I deal with them in correspondence, when I am only willing to negotiate in mediation? Would the judge see me as not co-operating?

            if the house is the only main asset. I would definitely try and mediate. The house should be valued and equity equally divided. Assuming you have equally contributed.

            If this can't be agreed then really seek legal advice.

            The court right up to final hearing will try and get you to mediate. If you still can't agree then the judge will decide. By this time it will be expensive (for both) and this needs to be taken into consideration. The solicitors and barristers will be the winners.

            We had 4 properties and a business so things alot more difficult. Although the offer i received was a joke but expected from a greedy husband who thought the marriage assets were all owned by him. Fortunately the Judge saw through the lies and hiding of assets and made a fair decision.

            My divorce from start to final hearing was over 1 year. It is still going on. and the court order is being argued now and disputed, very painful.
