    Hi

    I would like some advice please on the following.

    With the divorce petition answered by me last week based on Domestic Violence as a reason, I would like to take next steps to settle the property that we currently own together, however I am not in it. Just to add that there is no occupation order or non-molestation order raised against me.

    I am in a temporary accomodation (room share) for the last three months and would like to be re-instated into the property that we own together. Its a large three bedroom semi-detached - plenty of room of two people to live seperate lives. Do you think it is wise to ask for the keys for the locks that she changed?

    My aim is to get the discussion started on the property matter and also subtly hinting the current resident (ex-wife) of the property that I am not going to let go of the property that easily.
    Additionally my personal reason is that the room that I am staying has full of damp and I am coughing a lot. My contract is already coming to an end and I don't want to go find another property somewere else, without knowing how long this divorce matter is going to drag on for.

    I am sure that her and her solicitor will say no citing domestic violecne as a reason and it is not appropriate. I could deny which I did as part of the petition anyway. If they do say that then can I then ask for her to get into mediation immediately so that both needs of the property are met or is it too soon?

    I also like to talk to her before the mediation but my solicitor advised that it unlikely that she will want to talk to me and proposed to go into mediation.
