I don't know which way to turn.
I am trying to help a few people with legal issues at the moment and neglecting those closer to home.
Long story short.
My brother is terminally ill following a health issue last year.
I saved his life. He has no will written. He is not the brightest button either. He is constantly depressed and says he will refuse a transplant when the procedure is imminent.
That aside, I got his decree absolute signed off by the courts last year when he was on his deathbed in intensive care.
He has lived with my mother (who is now 80 years old) for the last 2 or 3 years. She looks after him. He is 52 years old.
His wife and one of their children still live in the former marital home.
The house is for sale for £75,000 and she refused to agree to a sale of £72,000 (50/50) in favour of a sale at £60,000 (£40k to my brother/ £20k to her) to someone she says she has given her word.
His name solely in on the deeds.
There is clearly something going on from her side.
I spoke to his solicitor yesterday and he says it is all very strange and that either she is getting a back hander or is having sexual relations with the proposed purchaser it would seem.
He says that she could assume squatters' rights if she wanted.
My brother has no written agreement that she should remain in the property since he moved out. He just let her live there.
She was the main breadwinner during the marriage. He is too ill to work. His son that is also living at home also has a job.
The solicitor states that there is no arrangement on the divorce papers about any assets and that she could potentially then take him for 50% of his remaining assets by going back to court to get a judgement.
I welcome your thoughts on this.
The exchange of contracts is imminent once the solicitor has confirmation from her and his son that they will vacate the property.
