  • Money owed by ex husband

    Good morning,

    My ex husband owes me over £2500 for child maintenance payments and repayments on a joint loan we took out whilst married.
    The pertinent points are as follows;
    - The payments are a private agreement made whilst he was in full time employment.
    - He is an electrician who had always worked hard before. He has now been out of work for a year due to an accident at work which he has said he is claiming for through a no win no fee solicitor. However, this has been the story for a year so I am not sure how true this is.
    - I have his agreement in writing over the amount that he owes me, but am not sure as to the legal validity of this.
    - He is an excellent father and my son loves him so I want to settle this amicably and without subconsciously using my son as leverage (tempting, but morally wrong).

    I would be grateful if anyone could let me know if there are any legal angles I can take to get him to pay back the money or at least re-start a payment plan per week - previously he paid me £65 per week and my household budget was done on this basis.

    Thank you in advance.
