Im writing on behalf of a friend of mine who is going through a divorce.
His wife left after 17 years of marriage without any warning and taking one of her motorbikes with her. Their teenage son still lives with his dad.
Things were amicable to start with as she came back to the marital home several times to collect her clothes etc (my friend never stopped her as he is a nice caring bloke). After she had collected all her things (including another motorbike) my friend received a solicitors letter saying his wife wanted a divorce and he was not to contact her. My friend got himself a solicitor (who didnt do much and charged him over £500 for a few hours work) but he is no further forward.
Anyway she had a bust up with her family and managed to get into social housing (my friend helped her move in and helped get basic essentials fridge, cooker etc) and thought she would just go through with the divorce without asking for any money. She then moved a man in (she said she just met him) and he has been living with her since June 2010. They both claim benefits (she says she has leg problems but she can walk her dog ok) so her solicitor says she cant make any payments on mortgage or loans. She gets legal aid to pay her solicitor.
There is a joint mortgage on the house (which my friend has kept paying in order to have a roof over his sons head) and a joint secured loan (again my friend keeps up the payments).
She sold the 2 motorbikes (worth around £700 each) and my friend has never seen a penny of the money even tho his solicitor told him not to sell anything.
My friend works hard for long hours and is struggling to make ends meet. His mum recently passed away and now he needs to replace his central heating system which has broken down.
As far as my friend is concerned she walked off, left him all the bills to pay and started a new life debt free while his is lumbered with all the debt. He thinks its unfair that she lives with her new boyfriend and does not have to pay anything towards the debts she helped to run up.
The latest letter from her solicitor is asking how much my friends pension is worth, asking for bank statements, pay slips and an income and expenditure. Is she entitled to all of this even though its his money and he is using it to pay the bills.
