  • Applying for spousal maintenance?

    I'm 2 years divorced and took less than I should due to abuse and control by ex at the time. The Judge forced ex to include nominal spousal maintenance in the financial consent order as he was disputing that as well.

    Ex did not disclose at time of divorce that he planned to marry woman he was cheating with, or the level of her income (very high earner).

    He earns roughly £50k and I am aware she earns a lot more than him, as does her own ex.

    They have a high standard of living due to her income, whereas I'm sole carer for our disabled child as ex has little to do with him (left when child was diagnosed as autistic).

    I have been getting by on part time income and UC, but am now being made redundant and have little prospect of finding new employment to fit around our son's needs (waiting for a specialized education place).

    Has anyone been successful in applying to have nominal spousal maintenance increased in these situations and do you know if the paying party's new spouse's income would be considered in any calculations?
