  • Separation and property

Hi, we are separating after 8 yrs and 2 children. Jointly own property which I will stay in with kids. Partner wants 50/50. Earns more than me and can move on quicker so i think more 30/70 so I can eventually move with kids , we will need more space eventually as it's a tiny flat and they are growing fast. I will struggle to buy alone if at all.
How do we get a percentage agreed and a charge on property without the expense of court. We r both low income so can't do court and on going legals , we need a quick fix etc.. many thanks

You get a percentage "agreed" by discussion and agreement. If it helps, you can try mediation. Failing that, if you cannot agree, the court can impose a decision.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf
