  • Help wanted. Do i Have to sell the family home

    I live in the family home with two kids. Ex returns part time.we have a joint mortgage. Ex wants the house to sold soon as possible so they can buy else were.
    I have proposed i stay in the house with the kids and we share the costs but they just want their equity. Do i have to sell? What if they take the kids?

      It is possible that the house will have to be sold. There is a lot more to be considered than has so far been said.

          See the Trusts of Alnd (Appointment of trustees) Act 1975. A court will look at that underlying trusts on which the land was bought and say whether those trusts have been satisfied and if not what has to take place before thay can be satisfied.

          So, as Atti says, there is a lot to consider before your question can be answered.
