    Hi quick question

    We are currently going through divorce and are asset splitting.

    Currently for me to take on house in my name mortgage company have said I would need to clear our joint debt first which is all in my name.

    This currently stands at 13 k
    My family have said they will lend me this 13k to clear it to enable me to take on the mortgage.

    My wife does not have the funds to pay her side of the debt initially but will be owed some money from me make up part of the 50/50 split.

    Am I right in saying I can just take of her part of the loan from the overall amount that I owe her ?

    Best do it by agreement.
    It depends upon the sequence, but in principle it may be ok subject to the court's approval.
