  • What to do if I don't approve of sealed order?

    I still have a lot to learn navigating the family court system, and find I am being burned being wise after the event. I'm on legal aid, but am starting to get the sense that legal aid lawyers are even more time-poor than the rest of the family court ....After our last Hearing in court, I received a draft order (written by my estranged husband's barrister on the day, but I only got it two days later), only an hour later received the sealed order from the court, which was significantly different to the draft order, and I didn't even get the opportunity to approve it. The main issue with that is that in the sealed order they snuck in a paragraph about me apparently being happy to have previously facilitated contact, which is absolutely not the case, and indeed at the hearing my barrister on that point noted that coercive control was an element in our relationship (we have yet to have a Fact Finding Hearing). However none of that is captured in the Order, so my issue is, with judges and everyone else being as time-poor as they are, they will read that I apparently had no problem facilitating contact in the order, and then perhaps come to the conclusion that I only developed these apparent domestic abuse concerns after the separation. It's almost a month later now - I'm guessing there is not much that I can do about it now? This is a bit of a concern as I understand the ex may now be preparing for an emergency order to force me to facilitate handover at my house (so ridiculous to be making a big deal about that, given that he'd have more time with the kids if I were to take them to a neutral place rather than have travel time eat into their contact hours, but anyway). I'm worried because like I said, a judge might read that paragraph in the previous order and come to the wrong conclusion - as I'm guessing an emergency order would be done in private and I won't get the chance to raise that point. Any advice / perspectives about my options?
