  • Fathers payments for his three daughters?

    My daughters husband left her a few years ago. He paid what the CSA said he had to pay, for his children, but I would like to ask a question. Apparently, my daughter and her ex approached a Solicitor and drew up an agreement which stated, he would pay a certain amount of money for his children, (to each of them rather than direct to my daughter), whilst they were studying at University. He paid the eldest for the first two years, stopped whilst she had a years work experience and did not start paying when she started her final year, this year. He has never started paying for the middle daughter, when she started her University in October last year,(2020) and has just informed my daughter he has stopped paying for the youngest because, although she is studying at college, she has started an apprenticeship associated with her college course.
    Does this 'contract' they made between themselves, with a solicitor, ( no courts involved), form a legal obligation? I might add it is not through lack of money that he has stopped paying, but purely selfishness.

    Was the agreement in writing or verbal?

      As far as I know, he stated it to my daughter at the time they were sorting out the CSA agreement, so it was probably verbal. I think he knew just what he was doing, having his daughters stay just long enough so he did not have to pay the full amount, then stating some days he could not have them. When his daughters were working whilst studying, asking them if they were managing okay. Of course they would say, 'yes' and hence he stops paying my daughter. All very manipulated, but when it is just verbal I suppose he gets away with everything.

        If you go to court for an order, especially for the youngest one as she is still at college, so child Benefit is still in payment?

        Go to court for all three as dependants.
