  • Where do I stand and what are my rights?

    Hi,

    My partner and I have been cohabiting since 2007. We have a joint mortgage on our current home and have a 5 year old child.

    Over the past 3 years or so the relationship has deteriorated and at times my partner's behaviour has been completely unreasonable (psychological and physical abuse, sometimes in front of a minor) which has contributed towards me having mental health issues.

    There was a "disagreement" a fortnight or so ago and I am now considering ending the relationship in the interests of my child's, and my own wellbeing.

    I'd like to understand where I stand from a financial point of view with regards to the family home, my savings and pension.

    Whilst our property was purchased via a joint mortgage, my partner has never contributed to the repayments. They did contribute a small amount towards the deposit but I have always covered the "upkeep". Will they automatically be entitled to 50% of the equity?
