My ex has left me and the property we shared..... Can i dispose of his possessions?

  • My ex has left me and the property we shared..... Can i dispose of his possessions?

    My ex partner left the rental home we shared on 31st August 2020.

    He has left all his possessions even though he has returned to the property on numerous occasions.

    In October 2020 he texted me to tell me to either put his belongings in the garage or throw them away.

    Can I legally dispose of his possessions since he has given me the option to do so.

    It's now been nearly 6 months since he left. I will be leaving this property at end of August.

    Am I legally able to give my ex's stuff to charity or throw them away if his earlier text told me I could dispose of them as it seems that he has no intention of taking his belongings?

    Message him to give a final chance to collect, give a time frame say end of this month. Then dispose of them if not collected.

      Thanks for your response. So by giving him notice to collect his stuff I will be legally within my right to dispose of his possessions ie giving his clothes to charity if he doesn't collect within timeframe set?

        Would be best to get a reply confirming his text to dispose of them. Save his earlier text if you still have it and your text to him re: removal and his replay.

        Basically cover as many bases as you can.

          I did acknowledge his request at the time telling him that I was surprised by this but would do as requested. He didn't backtrack and reply saying that he didn't want me to throw them away.

          When he visited the property since his departure (4 times in the last 6 months), he didn't take any items with him (his last visit being in December), so it shows me that he no longer requires them in the home he now shares with his new partner.

          I have made a copy of the texts but yes will cover all bases.

            We are now at a point where we will just be putting things that have sentimental value into boxes and worry about them later. Might this be an option for you too? It might never be easy to go through certain things, but maybe later on it might just be a tiny bit easier?

              Hi,

              Yes it was hard but I have put all his belongings in bin bags and put them in the garage. If, after receiving notice, my ex decides not come to collect his stuff, before I move out of the property, then I will dispose of them and give the clothes he left to charity.
