Need some help and advice here please;
Court hearing 2018 - Divorce settlement and pension
My partner went to court to settle all of the above and the outcome was that her ex-partner would receive a percentage of her pension to level up the pensions as he had a significantly smaller pot.
This order was made in October 2018
- He has yet to claim this from my partner - at the time the pension percentage he was awarded was worth around £60k
Questions on this are;
1) is there a time limit he can claim this money from her?
2) As my partners pension is still live, if he was to start the claim would the pension value at the time of the hearing be the value that was transferred over? This is the worry because the pot will have increased quite a bit 2 years on.
Our solicitor said at the time that the value of the pension at the time of the hearing would be the figure he got, not any figure later on.
