  • Pension advice

Hi just some advice as my legal cost have seriously mounted up and I’m still not divorced. I was married for 10 years had more lucrative job working for the NHS than my husband.I have one daughter. To be able to move I offered my husband 53% of the house with me having 47%. He also wants half my pension for the years married. He’s self employed so it’s difficult to see what he really earns. We live separately now. I’ve changed my mind on the finance of giving him my pension. No finances have been put into the court. But I signed some agreement before we moved.
however things have changed not as my daughter prefers to live with me now. I’m also five years older than him so I have to work till I’m 67 years. I feel it’s unfair to give him half of everything as I had a flat before meeting him so put in a large deposit. With him putting no finance in. He only contributed 1/3 of all bill during the marriage. What advice can you give me. I’m very capable and will have to everything myself as I refuse to spend anymore money .
    Thank you in advance.

Hi, there is a lot to consider in those circumstances and if the matter does proceed to Court, the Court will follow the basic guidelines set out in section 25 of the Matrimonial Causes Act 1973 when deciding the division of assets between you and your husband.

The following is a useful guide and may help provide some clarity to your situation - I hope it helps!
