  • Contact order- other parent being a stick in the mud

    I’m in the middle of a child contact order going through court. We had an order 4 years ago and I’ve applied to get this altered to reflect the agreement we had moved on to ourselves, at the time amicably.

    We were asked to write statements of how we would like the new order to look and the other parent has not written one and refuses to do so, saying he wants the old order to stand, even though we have no stuck to that for well over a year. And despite this meaning now less time with our son, which he is doing to spite me, as he sees him having him as doing me a favour!

    What happens if he refuses to write a statement?

    As I understand it, a contact Order is in place and you have made an application to vary that Order and have drafted a new proposed Order. The other parent has opposed that application and has no obligation to propose to the court any alternative draft Order aimed at varying the current Order.
